Houston car accident and personal injury settlements

Millions of dollars recovered for injured Texans. Those recoveries came from car accident settlements, commercial truck and 18-wheeler claims, and other personal injury matters across Harris County and the surrounding counties.

Every one of them started the same way: somebody was hurt by someone else’s carelessness, and an insurance company was hoping they would take the first number offered.

The kinds of claims behind those settlements

  • Car accident settlements. Rear-end collisions, intersection crashes, lane-change wrecks and highway pile-ups — the everyday collisions that make up most Houston injury claims. How a Houston car accident claim works.
  • Truck and 18-wheeler claims. Commercial vehicle cases carry federal record-keeping, a carrier’s own investigators and far larger policies than a car claim. Why a truck case is a different kind of case.
  • Uninsured and underinsured motorist claims. When the driver who caused the crash carried the state minimum or nothing at all, the claim turns to your own policy.
  • Serious injury claims. Disc injuries, fractures and surgical cases, where future medical care is a large part of what the claim is worth.
  • Claims involving a government vehicle. Shorter deadlines and different rules, which is why those need attention immediately.

Dump truck lane change

One contributing factor on the crash report. The truck driver.

A dump truck changed lanes when it was not safe and sideswiped the driver’s side of our client’s car on SH 288. Conservative care and epidural injections did not help, and he underwent a lumbar discectomy. The defense argued the herniations were degenerative, but he had never injured his back or been told he needed surgery before the crash. Filed in Brazoria County and taken through mediation.

Company van ran a red light

The van’s own dash camera sank the defense.

The video showed a clear view of the signal, undercutting the claim that trees blocked it. Injections did not help and our client underwent nerve surgery. We sued the employer directly for keeping a driver with prior violations on the road.

Our client’s car. The van’s own dash camera is what undid the defense.

Delivery van failed to yield

Two clients in one vehicle, both with surgery recommended.

The van pulled into the roadway and the police investigation cited its driver. The airbag deployed into the driver, who was treated with therapy, an epidural injection and a bilateral rhizotomy. Her passenger had strain injuries to the neck, shoulder and lower back, and an orthopedic surgeon recommended ligament reconstruction.

Rear-end chain reaction in a work van

A lumbar fusion, two years after the crash.

Our client was driving his employer’s van on Sam Houston Parkway when a pickup, pushed by a second truck that rear-ended it, struck him from behind. Disc herniations in his neck and back were treated with epidural and facet injections before surgery. Pursued through suit and mediation.

Tractor-trailer swerved into his lane

The defense blamed road debris. The evidence did not.

The trailer struck the passenger side of his pickup on IH-10 and a state trooper cited its driver. Neck and back injuries were treated with therapy, chiropractic care and cervical and lumbar epidural injections, and his surgeon recommended surgery on his lower back.

Lane change, driver and passenger

He admitted causing it. The injuries were permanent anyway.

Both clients had permanent disc herniations in the neck and low back, and the driver also injured her shoulder. Therapy, chiropractic care and spinal injections failed to give lasting relief, and each underwent a lumbar radiofrequency ablation.

Wheel through the windshield

A wheel left another vehicle and came through her glass.

Oilfield equipment injury

The crew objected to the lift. The supervisor ordered it anyway.

An oilfield worker was hurt while his crew installed a blowout preventer. We contended the operator’s supervisor ordered the equipment lifted with the rig’s block line instead of a forklift. A hoist line snagged and a bolt struck his hand, costing him part of a finger and leaving permanent disfigurement.

What decides a personal injury settlement

Settlement amounts are not assigned from a chart. Three things move them more than anything else, and two of them are outside your control once the crash has happened.

The medical record. A documented injury with consistent treatment argues for itself. Gaps in treatment are the single most common reason a claim is worth less than it should be.

How fault is divided. Texas reduces a recovery by the injured person’s share of the blame, and once that share passes half there is no recovery at all. That is why an adjuster’s early questions are rarely idle.

How much insurance exists. A claim can be worth more than the coverage available, and then the coverage decides it. The Texas minimum is $30,000 per injured person, and a great many drivers carry exactly that.

If you want the long version of that arithmetic, I have written it out: what a Texas car accident case is actually worth, and how long a settlement takes.

What a results page does not show

A list of recoveries is a set of outcomes with the reasons removed, and the reasons are what decide your case. Two claims with almost identical facts can end very differently because of the medical evidence, the fault argument and the policy limits behind them.

And not every case settles, nor should it. When an insurer will not pay what a claim is worth, the answer is a jury. Being willing to go there matters long before anyone walks into a courtroom — an adjuster who knows a file will actually be tried values it differently from one who assumes it will not.

So I will not point at a number and tell you what yours is worth. I will look at your bills, your policy and the other driver’s, and tell you plainly what is actually available — including when I think you do not need a lawyer at all.
